‘तैँले मेरो नाम लिँदै पत्रिकामा किन जे मन लाग्यो त्यही लेख्छस् ?’
‘को बोल्नु भो तपाई !’
‘तेरो बाउ !’
‘मेरो बाउ त म छ वर्षको हुँदा नै मरेका थिए ।’
‘अब तँ पनि मर्छस् !’
‘तर म त ८० वर्षसम्म सक्रिय जीवन बाँच्छु भनेर सोचिबसेको मान्छे हुँ !’
‘अब फेरि त्यसैगरी मेरो नाम लेखिस् भने ८० दिन पनि बाँच्दैनस् !’

यति भनेर उसले फोन राखिदियो । आवाज केही चिनेचिने जस्तो पनि लाग्यो तर यकिन गरेर भन्न सक्तिनँ ।

यो कुराकानी मैले मोबाइलमा रेकर्ड गरेको छु । तपाई चाहनुहुन्छ भने यसको एमपिथ्री अडियो साउन्ड सुनाउन सक्छु । ९८१०५५४४०० । उसको फोन नम्बर सेभ गरेको छु ।

एक–दुई पल्ट फोन गरी हेरेँ । तर, उठाएन । सम्भवतः ऊ मसँग कुरा गर्न चाहँदैन । मलाई मार्न चाहन्छ । र, त्यसका लागि समय पर्खिरहेको छ । योजना बुनिरहेको छ ।
म विस्मित छु, को हो त्यो जो मसँग यसरी अत्यन्त रिसाएको छ । मेरो लेखाइसँग चिढिएको छ । र, मलाई मार्न चाहन्छ ।
पक्कै फन्टुस फिक्सनको कोही पात्र हुनुपर्छ ।

लेखन कुञ्जमा हरेक शनिबार पुस्तक हटिया लाग्न थालेको छ ।
हटियामा बुख्याँचा पात्रहरूको जगजगी छ ।

हेर्दा सर्लक्क मान्छे जस्ता लाग्छन् तर बुख्याँचा बुख्याँचा नै हुन् । बाहिर भयङ्कर लाग्छन्, भित्र केही न केही ।

त्यही भींडमा पहिलो दिन नै भेटिए कृष्ण अविरल ।
कृष्ण अविरल सेलिब्रिटी नाम हो । भित्रैदेखि आदर गर्न मन लाग्छ । तर, जम्काभेटमा कर्कलाको पानी भइदिए । छुद्रता छताछुल्ल भइदियो । हेर्दा–हेर्दै सैतान देखिए देवता ठानेका मानिस । दुर्भाग्य मेरो ।

रक्तकुण्ड पढेँ । लालचुडी पढेँ । लालचुडीले भित्रैसम्म मन छोएको थियो । साँच्चिकै हो जस्तो लागेको थियो । उहिले समाचारपत्रको परिशिष्टाङ्क सौगातको सम्पादन गर्दा मैले ‘कृष्णप्रसाद भट्टराईहरू’ शीर्षकका लागि छानेका पात्रहरूमध्ये कृष्ण अविरलको नाम निकै सम्मानसाथ उल्लेख गरेको थिएँ । तर, पछि बुझ्दै जाँदा उनी त्यति स्पेस दिनुपर्ने पात्र होइन रहेछन् जस्तो लाग्यो । त्यत्तिकै कालो ढुङ्गालाई शालीग्राम ठानिबसेको रहेँछु ।

मञ्जरी प्रकाशन खोलेका छन् । महाकवि लक्ष्मीप्रसाद देवकोटाको मुनामदन छापेका छन् । पण्डित जगन्नाथ गुरागाईको गुणरत्नमाला छापेका छन् । एकपछि अर्को अनधिकृत कामहरू धमाधम गर्न थालेका छन् । अर्काको रचना छाप्न र बेच्न न कसैको अनुमति लिनुपर्ने न त्यसरी बेचेवापत कसैलाई लेखकश्व दिनुपर्ने । अदालतमा मुद्दा हाले पनि नलाग्ने । त्यसो त नेपालमा पनि प्रतिलिपि अधिकार कानुन छ । तर, कानुन बनाउनेहरूले बदमासी गर्न चाहनेहरूलाई प्रशस्त ठाउँ दिएका छन् । सिर्जना प्रकाशन भएको र सर्जकको मृत्यु भएको ५० वर्षपछि त्यस्तो कृति पब्लिक डोमेनमा जान्छ र त्यसको प्रयोग जसले पनि गर्न पाउँछ भन्ने लेखिएको छ । यही कानुनी दुलो समातेर भ्रष्टाचारको अँध्यारो गुफामा पसेका छन् अविरल । यसमा कानुनीभन्दा पनि नैतिकताको प्रश्न बढी छ । उनबाट नैतिकताको कति आस गर्ने नगर्ने त्यो विद्वान लेखक कविहरूकै जिम्मा ।

पछिल्लोपटक मञ्जरी प्रकाशनबाट मनु ब्राजाकीका गजलको किताब छाप्छु भन्दै लिखित सम्झौता गरेका रहेछन् अविरलले । ब्राजाकी जीवित छँदाकै कुरा हो यो । ब्राजाकीको निधनपछि एकदिन लेखन कुञ्जमा भेट हुँदा एक जिज्ञासु शुभेच्छुकको तहबाट जीवनपानीले सोधे, ‘मञ्जरी प्रकाशनबाट मनु ब्राजाकीको गजलको किताब कहिले छापिँदैछ ?’

सुन्नासाथ भरक्क भड्किहाले अविरल ।

‘छाप्दिनँ म त्यो । सम्झौता, पाण्डुलिपि जे छ सबै च्यातिदिए हुन्छ ।’
यस्तै छुद्र वचन बोले उनले । म साक्षी छु । जीवनपानी अक्क न बक्क भए । के बोल्नु के नबोल्नु ! यसले पो केही बोल्छ कि भनेर मतिर फर्केर हेरे ।

‘ओहो, किन यसरी उत्तेजित हुनुभएको अविरलजी ? यो त समाचार बन्ने प्रसङ्ग होला जस्तो छ । तपाई आफैँ पत्रकारिता बुझेको मान्छे । बिस्तारी बोल्दा, छलफल गर्दा पनि हुन्छ नि होइन र !,’ मैले अविरललाई शान्त हुन आग्रह गर्दै भनेँ ।
‘लेखिदिए हुन्छ समाचार । केही फरक पर्दैन,’ उनले यस्तै भने र जुरुक्क उठे । सरासर पुस्तक हटियाको भिंडमा हराए ।

त्यत्रो उचाइ चुमेको लेखक, प्रकासकको यो व्यवहार ? मैले कल्पना पनि गरेको थिइनँ ।

चोरबाटो हिँड्नेहरूसँग कसैगरी नसकिने । काँक्रा चोरलाई मुड्के सास्ती, यस्तै बेलामा काम लाग्ने उखान सम्झना हुन्छ ।

म ब्राजाकीका दरपिया पार्टनर खोजी–खोजी हिँड्दै थिएँ । दारु खान होइन, दारुका बारेमा कुरा गर्न पनि होइन ।

बेस्ट सेलर कथाकार, गजलगो, संस्मरण लेखक मनु ब्राजाकी जीवित छँदैको सन्दर्भ हो यो ।

सर्वाधिक खोजी सूचीमा रहेका पात्रहरूमध्ये एक थिए चर्चित लेखक, पत्रकार, सम्पादक, टेलिभिजन प्रस्तोता किशोर नेपाल झुत्रे ।

पछिल्ला दिनमा बिरामीका कारण मनु ब्राजाकीको कलम सुस्ताइसकेको थियो । शारीरिक रूपमा पनि गल्दै गएका थिए । उनको जीवनका बारेमा शुभेच्छुकहरूका मनमा चिसो पस्न थालेको थियो । यस्तो पृष्ठभूमिमा म, विमल अधिकारी, सुनील पुरी र जीवन पानी मिलेर ब्राजाकीको जीवनकालमै उनको आत्मकथा (संस्मरण) र हामी शुभेच्छुकहरूको ब्राजाकी बारेका भनाइ समेटेर एउटा दस्तावेज तयार गर्ने सल्लाह भयो । नाम राखियो मनमौजी । मित्र रमेश पौडेलले कभर डिजाइन पनि तयार पारे ।

तर, मनु ब्राजाकीलाई नामको हिज्जे मन परेन । ‘मनमौजी नेपाली शब्द होइन, मनमोजी हो, त्यसैले किताबको नाम मनमोजी नै राख्नु पर्छ,’ ब्राजाकीको तर्क थियो । ‘मनमौजी नेपाली जनजीवनमा भिजेको शब्द हो, बोल्दा मनमौजी नै भनिन्छ, यही ठिक छ,’ हाम्रो प्रतिवाद थियो । तर, हामी नामको लफडामा अल्झेका थिएनौँ । नामका बारेमा पछि सोचौँला भनेर रचना सङ्कलन अभियानतिर लागेका थियौँ ।
त्यही सिलसिलामा हो मैले किशोर नेपाललाई खोजेको ।

महासागरले पनि त्यति मानिस डुबाएन, जति रक्सीले डुबायो । मेटास तासियोका शब्द ।

किशोर नेपालका बारेमा मैले सुनेको थिएँ, उनी रक्सी र सितनका बारेमा निकै उदार छन्, जस्तो पनि खाइदिन्छन् । मनु ब्राजाकी जस्तै । त्यसैले तँतँ–ममको स्तरमा उनीहरूको दोस्ती जमेको हुनुपर्छ ।

नेपाल राम्रो लेख्छन्, यसमा कुनै शङ्का छैन । युवादेखि अग्रज पुस्तासम्मले उनलाई पढ्छन्, यसमा पनि कुनै शङ्का छैन । पुतलीहरूप्रति उनको आकर्षण गजबको छ भन्ने पनि मैले सुनेको थिएँ ।

पच्चीसौँ पटकको फोन–सम्पर्कपछि बल्लबल्ल बत्तीसपुतलीको एउटा कफी रेस्टुरेन्टमा हाम्रो भेटघाट हुने तय भयो ।

मनु ब्राजाकीका अर्का दारु पार्टनर गजलगो ज्ञानुवाकर पौडेल दाइको पुररानो घरबाट गन्दै जाँदा त्यही साइडमा ३२ औँ नम्बरको घरमा रहेछ, त्यो रेस्टुरेन्ट ।
करिब आधा घण्टा कुरेपछि आए ।

उनी त्यहाँका नियमित ग्राहक रहेछन्, भेट्न चाहने मान्छेलाई प्रायः यहीँ बोलाउँदा हुन् ।

उनले कफी हुन्छ भनेर सोधे । मैले हुन्छ भनेँ ।
आइसब्रेकपछि मैले आफ्नो उद्देश्य बताएँ । मनु ब्राजाकीसँगको पहिलो भेटघाट र हिमचिमको सन्दर्भ सोधेँ ।

‘तपाईहरू उसलाई देवत्वकरण गर्न चाहिरहनुभएको रहेछ । म यस विषयमा केही कुरा बोल्न चाहन्न,’ उनले झर्केर भने ।

‘तैपनि दाइ मनु ब्राजाकीसँग जोडिएका संस्मरणहरू केही भनिदिनु न,’ मैले रेकर्ड अन गरेँ ।

‘मैले भनेँ नि देवत्वकरणलाई सहयोग पुग्ने म कुनै कुरा गर्न चाहन्न । यो रेकर्ड अफ् गर्नुस्,’ उनले थर्काए ।

खोदा पहाड निकला चुहा ।

‘मनु ब्राजाकी तपाईको साथी त हो नि,’ मैले क्षुब्ध हुँदै सोधेँ ।
‘हो, तर यो विषयमा मलाई कुनै कुरा गर्नु छैन । अरू नै कुनै विषय छ भने भन्नुस् । भेट्न खोज्नुभएको थियो, भेट भयो । कफी खानुस् । जानुस्,’ उनले रुखो स्वरमा यस्तै भने ।

तपाईलाई पत्यार लाग्दैन भने म यसको थोरै एमपिपिथ्री रेकर्ड पनि सुनाउन सक्छु । घटनास्थलको अलिअलि छेकछन्द रेकर्ड भएको छ ।

कफी लिएर आउने भाइ पनि उनको व्यवहार देखेर छक्क प¥यो ।

किशोर नेपाल कान्तिपुरमा हुँदा म समाचारपत्रको डेस्कमा थिएँ । मनु ब्राजाकीको उपन्यास ‘कान्छी बेगम’ सौगातमा धारावाहिक छाप्दै थिएँ । कान्छी बेगमको सफ्ट–कपी लिएर आउँदा वा अरू नै बेला पनि ‘कान्तिपुरमा मेरो साथी छ, किशोर नेपाल झुत्रे, ऊ राम्रो आख्यानकार हो, राम्रो लेख्छ,’ भनेर निकै अदपका साथ नाम लिन्थे । प्रशंसा गर्थे । किशोर नेपालको उपनाम झुत्रे हो भनेर मैले मनु ब्राजाकीले भनेपछि नै थाहा पाएको थिएँ ।

मलाई निकै छट्पटी भयो । कफी खाऊँ कि के गरुँ । जुरुक्क उठेर हिँडुँ कि ट्वाल्ल परेर बसिरहुँ । केहीबेर चुपचाप बसेपछि कफी खाने निधो गरेँ । खानेकुरासँग केको रिस !
कफी निकै कडा र तीतो थियो । झुत्रेको झुत्रो व्यवहारजस्तै ।

प्रतीक प्रधानसँग मेरो त्यति लामो उठबस होइन । आदरणीय कथाकार दाइ परशु प्रधानका छोराका रूपमा चिन्थेँ । साहित्यकार दाइ शैलेन्द्र साकारका भतिजा प्रतीक पत्रकारिता पढेलेखेका राम्रा मान्छे हुन् भन्ने थियो । मनको एउटा कुनामा त्यही अनुरूपको अपनत्व, त्यही अनुरूपको आदर थियो ।
तर यहाँ पनि ढाकके तीन पात भइदियो ।

प्रतीक प्रधान नागरिक दैनिकको सम्पादक थिए । म त्यसैको पूर्वाञ्चल संस्करण पूर्वेलीको सम्पादन डेस्कमा थिएँ । इटहरीबाट दैनिक विराटनगर आऊजाऊ गर्थेँ ।
ती दिनहरूमा मलाई इटहरी छोडेर काठमाडौँ आउन निकै हुटहुटी लागेको थियो । परस्पर जिल्लान्तर सरुवाको कागजात नियमानुसार मिलाउँदै थिएँ । इटहरीको घर–जग्गा बेचिसकेको थिएँ । काठमाडौँमा, नैकापमा बस्ने हो भनेर नवराज लुइटेललाई एक लाख रुपियाँ बैना पनि दिइसकेको थिएँ ।

नागरिक पूर्वेली डेस्कबाट केन्द्रमै सरुवा हुन्छ कि भनेर प्रयास गरेँ । सम्पादक प्रधानलाई भेटेर भनेँ । उनले विश्वमणि पोखरेलतिर देखाइदिए । अख्तियारप्राप्त पोखरेलले मलाई काठमाडौँमा काम दिनेबारे कुनै रुचि देखाएनन् । अन्ततः मैले पूर्वेली डेस्कको काम छोड्ने निर्णयसहित राजीनामा–पत्र दर्ता गराएँ ।

कुनै पनि सञ्चार–संस्था छोड्दा काम गरेको अवधिभरिका लागि सम्पादकबाट थ्याङ्कस् लेटर लेखाएर लिने मेरो बानी छ । राजीनामा दिएसँगै सम्पादक प्रधानसँग थ्याङ्कस् लेटरका लागि अनुरोध गरेँ ।

‘हुन्छ, भोलि आउनू, म लेखेर राखिदिन्छु,’ उनले भने ।

भोलि गएँ । पत्र लेखेर राखिएको थिएन । कार्यकक्षअगाडि निकैबेर कुरेँ । प्रधान आएनन् । फोन गरेँ फोन उठाएनन् ।

पर्सिपल्ट फोनमा कुरा भयो । उनले पत्र लेखेर नागरिकमै काम गर्ने मेरा मित्र छत्र क्षितिजलाई छोडिदिने बताए ।

त्यसको भोलिपल्ट फेरि नागरिकको अफिस पुगेँ । छत्रले, सम्पादकले आफूलाई त्यस्तो पत्र नदिएको र त्यसबारेमा कुनै सल्लाह पनि नभएको बताए । झिँजो मान्दै फोन गरेँ । दुई पटक पूरा डायल गर्दा पनि प्रधानले फोन उठाएनन् ।

निकोर्सिपल्ट फेरि नागरिकको अफिस पुगेँ । प्रधान कार्यकक्षमै रहेछन् ।
‘दाइ ! खोइ थ्याङ्स लेटर त लेखिदिनुभएको रहेनछ ।’
‘केको हो यो ताकिता ! दिन्छु भनेपछि म आफ्नो समय मिलाएर दिन्छु । तपाई बाहिर जानुस् !’

आफ्ना लागि गेट आउटको नेपाली रूपान्तर प्रधानका मुखबाट सुन्नासाथ म छाँगाबाट खसेझैँ भएँ । नसोचेको आइलाग्यो । सारा मान–सम्मान, आदर–सत्कार, सकारात्मक भावना झ¥याम्झुरुम् भयो ।

Demanding an amendment in the provision related to pardoning provision by the president with the recommendation of Chief District officer (CDO), Jailer and Prison Management Department (PMD) a writ petition of certiorari has been filed at the Apex court Monday.

Advocates trio Bhadra Prasad Nepal also known as Swagat Nepal, Hari Sharan Jamrkattel, Kaushal Kumar Bhattarai and a prisoner at Nakhkhu jail Lalitpur  Bishnu Bahadur Chhetri, for deception charges, are the applicants of the writ at the Supreme Court (SC).

It is claimed in the writ petition that the Prison Management Directive has violated the constitutionalism and allowed the prison administration, jailor and the Chief District Officer to decrease the imprisonment duration.

The rapists are not allowed to for pardon while murderers are eligible for that that’s why the crime of murder after rape has been increased, writ petitioners have said.

Similarly, the Jail regulation has not disallowed for the persons who are in jail in for fraud cases to have pardon by the president but the directive issued by the JMD has prohibited it with its own decision.

The writ has also demanded to stop these contradictions between the legal provisions and the Jail Management Directive.
The hearing on the case has been scheduled for Friday.

On Tuesday , 10th May,2016 it came to be explored that the Commission for the Investigation of Abuse of Authority (CIAA) had filed a charge sheet at the Special Court, Kathmandu. The sheet was filed against the Surveyor as he demanded a huge sum of money from the service seeker.

CIAA has filed a charge sheet at the Special Court, Kathmandu against of surveyor Jiwachha Yadav of Survey Office Nepalganj Banke, for demanding/receiving Rs 1,00,000/-  bribe from Service seeker . Due to all these activities, the citizen are losing their faith upon the Government.

Therefore, the CIAA has filed the sheet for the maximum punishment as per Sec 3(1) and 3(1)(c) of the Prevention of Corruption Act 2002.

What happens when an investigator for abuse of authority him or herself involves in a corruption!

But, it has happened so many times.

Sunday it came to be explored when the Commission for investigation of Abuse of Authority (CIAA) filed a case against an Assistant Sun Inspector or Police at special court for submitting fake and forged certificate of Secondary level.

According to the source Asst. Sub Inspactor Chitra Bahadur Karki had acquired the fake certificates from Bihar School Examination Board, India, in the year 1992 AD for the purpose of Promotion.

Therefore, CIAA has filed the charge sheet claiming for maximum punishment under sec 12 and 29 of the Corruption Control Act, 1961 and sec 16(1) of prevailing Prevention of Corruption Act 2002.

Thursday the Special court had acquitted the then Director General Dr Mingmar Gyelzen Sherpa and 10 officials of the Department of Health Services of corruption charges.

The Nepals ambudsman Commission for the Investigation of Abuse of Authority (CIAA) had moved the court against them.
Taking the hering of the case The court had clearify them  in  anti-graft body.

They were accusee of misappropriatin the public funds in  importing medicines for pregnant women in remote hilly region of Nepal. CIAA had also sought a total fine of Rs 72,713,908 from all the accused.

The then chief of Supply Management Division of the Department of Health Dr Naresh Pratap KC, the then senior director of the same division Krishna Bahadur Chand, and serving officer of Procurement Unit of the Supply Division Pawan Koirala were accused of missusing the public fund.

On the same way, last year, the court had given clean chit to public health officer Ram Sundar Yadav and public health inspector Hemlal Gyawali saying that the C I AA could not provid evidences of their involvement in irregularities as charged by the CIAA.

Most or the cases are unsuccessful in front or the bench or Special court, why?

Now its interrogatted why court is regularly compelled  to give the clean chit?

17 January 2016, Kahtmandu : In Nepal we don’t have any official national ‘Thanks Giving Day’ as in Europe or any other country in the world. But, in practice most probably Nepal is a country where in the huge number of programs are organized for extending appreciation to seniors and the personalities who have contributed in national lives.

No doubt, most of organizer and organizations take money also for admiration and felicitate with appreciation letters. How funny it is, one can’t imagine. But, Sunday, in Kathmandu, capital city of Nepal a program was organized where the organizer was not running after donation to tribute someone. Yes, the organizer was Special School for Disable and Rehabilitation Centre (SSDRC), a nongovernmental and nonprofit making organization.

At the function SSDRC honored Senior Superintendent of Police of Kathmandu Valley, Sarwendra Khanal, Deputy Superintendent of Police duo Dan Bahadur Karki and Narayan Prasad Chimoriya and Inspector yogendra Thapa with garland and appreciation letters.

Addressing the program, Sabita Upreti, Founding Chief Executive Director of SSDRC said SSP Khanal   really deserve the highest level of honor for maintaining the law and order adequate in society was ever observed in Kathmandu.

In presence of senior journo Balaram Pyasi and more the students had performed several entertaining item of their skills developed by SSDRC.

The program was really a ‘malafied interest-less’ where good police is getting the more appreciation from such an organization like SSDRC and public level. Though we don’t have ‘Thanks giving day’ thanks SSDRC and Nepal Police including such the honest police officer Sarwendra Khanal who are the ray of hope for children, future of Nepal.

Kathmandu, 14 January 2016: The victim of gang rape Puja Bohara passed her Grade XI with the higher marks of division.

According to the result published today by Higher Secondary Education Board (HSEB), Puja has upgraded with the appreciable number 70 %. from grade 11 to 12.

Puja was raped by Sagar Bhatta of Bhumeswar 3  Baitadi, and Amar Awasthi of Gujar 2  while going to buy guess paper of Mathematics  for SLC examination. In 2013, both of them were fined 50 thousand Rupees and imprisonment of 13 years by the justice Himalaya Pathak at district court Baitadi. But, taking the appeal into its hearing the appellate court of Kanchanpur had proved innocent. The decision of the division bench consisting of justices Narabahadur Shahi and Ramesh Prasad Rajbhandari of appellate Court is now challenged by Puja Bohara at the Supreme Court.

Puja Bohara was surprised when she knew that the rapists were released. She had also written an open letter to then minister for law and justice Narahari Aacharya through the media. She had raised the question that either to punish her if she  was wrong or she would condemn the perpetrators to be punished. In answer  affirmatively, then minister Aacharya also had assured her to guarantee full justice. The minister  had also thanked to Raksha Nepal for providing shelter to Puja Bohara.

After the media discussion through the open letter to the minister Aacharya and Ms Bohara former Prime minister Baburam Bhattarai had also spoken out on national dailies expressing his commitment to provide justice to Bohara.

After the result Menuka Thapa, chairperson of the Raksha Nepal that provides shelter to Puja and more rape victims, has expressed contentment on her facebook this evening.

Thapa has thanked to all well-wishers and  quoted that Puja does deserve the highest level of courage and conviction. She has also achieved many more awards and medals in different level sports and examinations like Gold medal for Nepal in an International Taekwondo Competition in Korea, Distinction in SLC examination and more… But the criminals are still moving around. Kathmandu, 14 Jan, 2016: The Supreme Court (SC) of Nepal has banned for  withdrawals of politically motivated cases.

SC has also made it clear that because of withdrawals of such cases in recommendation of political parties the criminal justice system and good governance in the country may be seriously challenged.

The constitutional bench of the SC has also made meaningless to some of the cases which were decided for withdrawals in near past.

The reliable source at the ministry made it clear that the CDO of  Bhaktapur district CDO Toyam Raya has been transferred to Morang district.

Likewise, the CDO of Kavre district Madan Bhujel to Jhapa and Jhapa’s Tej Prasad Poudel has been transferred to Bhaktapur.

Similarly, Bal Krishna Panthi of Bara has been sent to Kavre, Bal Dev Gautam to Gorkha from Surkhet, Mahadev Pantha to Nawalparasi from Tanahun and Purushottam Kunwar to Tanahun from Home Ministry.

At the same time Gorkha’s Uddhav Timilsena has been transferred to the Tribhuvan International Airport immigration department while Bishnu Bahadur Thapa from TIA has been sent to Bardiya. Yadav Koirala has been transferred to the Peace Security Unit of Home Ministry.

Taking a hearing of a writ filed by senior advocate Shambhu Thapa against the investigation made by CIAA and (DRI), The SC has also phrased their conduct as illegal.

SC also has ruled CIAA to investigate within the limitation of jurisdiction.

CIAA had filed a case against senior advocate Thapa accusing him of evading the taxes at the Special Court.  In response, Thapa had also registered the writ petition of certiorari and mandamus September 6, 2013.  During the raid conducted by CIA A and  the Department had taken most the documents related to clients and other articles from the law firm, Legal Advisers’ Forum.

In the writ petition Thapa had argued that the action conducted by CIAA was  a violation of constitutional right to privacy.

‘This verdict has guaranteed the privilege of lawyers and secrecy of the professional procedurals’ Nahakul Subedi, spokesperson for the  Supreme Court said.

The SC also has raised the question why the raid was conducted without any appropriate investigations.  Most of the lawyers have made their response on the verdict that this precedent has established a mile stone for right to privacy and dignity of the legal practitioners.

Senior Advocate Shambhu Thapa has also said to this online on phone that this case was not only because of accusing him of evading taxes but also for the protection of clients interest and privacy right.

He added that there was no complaints by the government about his tax clearance, I have paid all of the revenues.

Finally the SC has also made it clear that CIAA has not adequate investigation on it that’s why the writ is issued affirmatively with the verdict for ruling CIAA to stay within the limitation of jurisdiction and not to cross it.

The case was widely discussed as the issue of ego between Thapa and Lok Man Singh Karki, Chief Commissioner of CIAA.
